PRIVACY POLICY

When you use the Service, you consent to our collection, use, and disclosure of information about you as described in this Privacy Policy.

This Privacy Policy describes our policies on the collection, use, and disclosure of information about you in connection with your use of our services, including those offered through our websites, emails, and mobile applications (collectively, the "Service"). The terms "we", "us", and "Adviise" refer to: (i) Adviise, Inc., a Texas Corporation with its headquarters in Dallas, Texas, if you are a resident of the United States or Canada.

FOR PROVIDER ACCOUNTS

  1. Personal Information Collected

Adviise collects publicly available information about physicians in a database to provide a directory and referral service. This information includes your name, office address, office phone and fax numbers, specialty, and the medical school and training institutions you attended. Almost all doctors, and many other healthcare professionals, are included in our database. If you choose to register and become a User, you will verify that the information that we have collected about you is accurate.

The purpose of Adviise is to permit Users to add to the publicly available information about themselves in order to develop, maintain and enhance their network of patients.

If you have any hesitation about providing such information to us and/or having such information displayed on the Adviise website or otherwise used in any manner permitted in this Privacy Policy and the User Agreement, you may refrain from providing this information. The only information that you are required to provide in order to become a member of Adviise is your email address, full name, and NPI. By default, your email address is not published in your Adviise profile, and we will use it only to send you product updates and information. You can, of course, opt not to receive these updates.

If an authorized third party, such as an administrator in your office, completes the registration form on your behalf, both you and that third party will be deemed to have accepted all of the terms of this Privacy Policy.

We collect personal information from you at the following times:

REGISTRATION

The following fields are required during registration to guarantee Adviise is an accurate directory for its members: name, address, specialty, office phone, occupation, email address and password. Most of this information, other than your email address, will already be included in your profile, but we ask that you verify that the information is correct, and update it where necessary. All of the information that is publicly available or you voluntarily provide will be included in your profile, which is accessible to anyone browsing Adviise.

When You Invite Others to Join Adviise

If you wish to invite your colleagues to join Adviise, you may enter their names and email addresses, which Adviise will use to send your invitation including a message that you write. The names and email addresses of people that you invite will be used only to send your invitation and reminders.

When You Contact Support

Adviise may collect information through our website or through Support in order to, among other things, accurately categorize and respond to your inquiry and deliver appropriate service levels.

Cookies

Like most websites, Adviise uses cookies and web log files to track site usage. A cookie is a tiny data file which resides on your computer which allows Adviise to recognize you as a User when you return to the Adviise website using the same computer and web browser. Like the information you enter at registration or when you update your Profile, cookie and log file data is used to customize your experience on our website. One type of cookie, known as a “persistent” cookie, is set once you’ve logged in to your Adviise account. The next time you visit the Adviise website, the persistent cookie will allow us to recognize you as an existing User so you will not need to log in before using the service. However, if you log out of the Adviise website you will need to re-enter your password the next time you visit in order to log in to your account. We use cookies to improve the quality of our service by storing User preferences and tracking User trends. Most browsers are initially set up to accept cookies, but you can reset your browser to refuse all cookies or to indicate when a cookie is being sent.

Log files, IP addresses and information about your computer and mobile device

Due to the communications standards on the internet, when you visit the Adviise website we automatically receive the URL of the site from which you came and the site to which you are going when you leave Adviise. Adviise also receives the internet protocol (“IP”) address of your computer (or the proxy server you use to access the World Wide Web), your computer operating system and type of web browser you are using, email patterns, mobile device operating system (if you are accessing Adviise using a mobile device), as well as the name of your ISP or your mobile carrier. We use this information to analyze overall trends to help improve the service. The linkage between your IP address and your personally identifiable information is not shared with third parties without your permission, except as described in Section 2 (“Legal Disclaimer” and “Disclosures to Others”), below.

Consent to Adviise Processing Information About You

Certain information you provide to Adviise may reveal, or allow others to identify, your nationality, ethnic origin, religion or other aspects of your private life, and more generally about you. Please be aware that in providing information to Adviise for the purposes of opening your user account, you are expressly and voluntarily accepting the terms and conditions of this Privacy Policy and Adviise’s User Agreement. The supplying of all such information by you to Adviise, including all information deemed "personal" or “sensitive” by applicable law, is entirely voluntary on your part. You have the right to withdraw your consent at any time, in accordance with the terms of this Privacy Policy and the User Agreement, but please note that your withdrawal of consent will not be retroactive.

Rights to Access, Correct and Eliminate Information About You

You have a right to access, modify, correct and eliminate the data about you, which has been collected pursuant to your decision to become a User. If you update any of your information, we may keep a copy of the information which you originally provided to us in our archives for uses documented herein. We take your rights seriously and encourage you to use them if you deem this to be appropriate. You may exercise these rights by emailing us at How@Adviise.com.

  1. Uses of Personal Information

Adviise is an online service dedicated to helping medical professionals organize their online presence. The information you choose to provide about yourself on our service is used to help you describe yourself to other Users. If you close your Adviise account, we will remove all of the personal information that you have provided to Adviise from our publicly viewable database, as well as any private profile information that you have stored with us. We will retain the publicly available data in the database, including all of the information about you that was available on our database prior to your joining the Adviise network. Other information, that does not personally identify you as an individual, is collected by Adviise from Users (such as, for example, patterns of utilization) and is exclusively owned by Adviise. This information can be utilized by Adviise in such manner as Adviise, in its sole discretion, deems appropriate.

Adviise's Communications to You

Adviise will communicate with you through email and notices posted on the Adviise website or through other means available through the service, including text and other forms of messaging. If we send any communications to you via the carrier service with which you have a mobile communications subscription or otherwise have access, you understand you will pay any service fees associated with any such access (including text messaging charges for messages to your mobile device). Our communications to you include emails which help inform Users about various features of the service. Adviise may send you promotional information unless you have opted out of receiving such information. You can change your email and contact preferences at any time by sending a request to How@Adviise.com or by updating your profile information.

Sharing Information with Third Parties

Adviise takes the privacy of Users very seriously. We do not sell, rent, or otherwise provide your private information to third parties for marketing or other purposes. We may provide data about the usage of our services with third party service providers with whom we contract to help us provide our Services. For example, we may work with vendors, consultants or other third parties to host and maintain our data and website properties, analyze our data, or provide marketing assistance. All contracted third parties must agree not to use your personal information and communications other than to fulfill their responsibilities to us and are bound by confidentiality agreements with regard to their use of such information. We may provide aggregated anonymous data about the usage of our services to third parties for such purposes as we deem, in our sole discretion, to be appropriate, including to prospective investors in Adviise. We may segment our Users by specialty, education, alumni groups, training, research, grants, trials, geographic location or other similar information and provide information from your public profile as part of our Services and product offerings. If you would like to be excluded from the aggregated research or products based upon aggregated or segmented data and Users’ activities on the site, please email How@Adviise.com.

As part of our Services, we may also share public profile information with medical leading publications and ranking bodies, such as U.S. News and World Reports to increase the visibility of our Users.

When you use Adviise through the Adviise website, newsletter, mobile app or other medium, you may be presented with advertisements or opportunities to engage in informational programs consisting of sponsor-selected content. Examples of these programs include sponsored news alerts or branded or unbranded discussion groups. All sponsored programs will be labeled clearly as sponsored.

When you choose to engage with a sponsored program, such as engaging with a commercial client’s sponsored news alert, we may provide our commercial clients with your identifiable information and information about the type of engagement (e.g., whether you viewed, interacted with or requested information about such promotional content). We will only share your identifiable information with clients who have agreed to use such information solely for authorized purposes.

To confirm, we will not provide your personal contact information such as email, phone, fax, or postal address as part of our Services.

You may revoke your authorization to participate in these features of our Services at anytime. If you would like to be excluded from the accredited bodies, leading publications or commercial features of our Services, please email How@Adviise.com.

Search

We offer search services to help you find information and learn more about other Users (for example, you can search for Users with particular expertise, or that you may know from your medical school). We use information from User profiles and other contributions to Adviise to inform and refine our search service.

Surveys and Polls

As a User, you may receive requests to participate in market research including polls and surveys submitted by other Adviise members. If you participate in surveys and polls offered through our website, the information you provide may be visible to others using the Adviise website. You may opt-out of participating by emailing How@Adviise.com to stop receiving these inquiries and requests.

Legal Disclaimer

It is possible that we may need to disclose personal information when required by law, such as responses to civil or criminal subpoenas, or other requests by law enforcement personnel. We will disclose such information when we have a good-faith belief that it is necessary to comply with a court order, ongoing judicial proceeding, subpoena, or other legal process or request to Adviise brought in any country throughout the world, or to exercise our legal rights or defend against legal claims.

Disclosures to others

We may also disclose your personal and other information you provide, to another third party as part of a reorganization or a sale of substantially all of the business of Adviise. Any third party to which we transfer or sell Adviise’s assets will have the right to continue to use the personal and other information that you provide to us.

 

  1. Your Information Choices

Accessing and Changing Your Account Information

You can review the personal information you provided us and make any desired changes to the information you publish, or to the settings for your Adviise account, including your email and contact preferences, at any time by emailing How@Adviise.com. You can also make these changes on the Adviise website by updating your Profile. Please be aware that even after your request for a change is processed, Adviise may, for a time, retain residual information about you in its backup and/or archival copies of its database.

Closing Your Account/Unclaiming Your Profile

You can also close your account at any time by emailing How@Adviise.com If you close your Adviise account, we will remove all of the information that you have provided to Adviise from our publicly viewable database, as well as any private profile information that you have stored with us. We will retain the publicly available data in the database, including all of the information about you that was available on our database prior to your joining the Adviise network. We may also retain certain data contributed by you if we believe it may be necessary to prevent fraud or future abuse, or for legitimate business purposes, such as analysis of aggregated, non-personally identifiable data, account recovery, or if required by law.

Adviise may also retain and use your information if necessary to provide the Services to other Users. For example, other information you have shared with others, or that other Users have copied, may also remain visible. This includes personal health information that you communicate through the Adviise Services. Adviise disclaims any liability in relation to the deletion or retention (subject to the terms herein) of information or any obligation not to delete the information. Adviise does not control when search engines update their cache, which may contain certain public profile information that has since been removed from Adviise’s publicly viewable database.

To request that we close your account and remove your information from the Adviise website, please send your request to How@Adviise.com. Please send your request using an email account that you have registered with Adviise under your name. You will receive a response within five business days of its receipt.

Memorializing Accounts

If we learn that a User is deceased, we may memorialize the User's account. In these cases we may restrict profile access, remove information, and close an account if we receive a formal request from the User's next of kin or other proper legal request to do so.

  1. Your Obligations

As a User, you have certain obligations toward the other Users with whom you will be communicating. Certain of these obligations are imposed by applicable law and regulations, and others have become commonplace in user-friendly communities of like-minded members, such as Adviise:

  1. You must, at all times, respect the terms and conditions of the then-current Privacy Policy and the User Agreement. This includes respecting all intellectual property rights which may belong to third parties (such as photographs).

  2. You must not download or otherwise disseminate any information which may be deemed to be injurious, defamatory, violent, offensive, racist, sexist or xenophobic, or which may otherwise violate the purpose and spirit of Adviise and its community of Users.

  3. You must not provide information to Adviise and /or other Users which you believe might be injurious or detrimental to your person, professional or social status.

  4. Those found soliciting, scamming, or spamming other members will be removed or suspended from the network at our sole discretion.

Any violation of these guidelines may lead to the restriction, suspension or termination of your account by Adviise, as we take these principles seriously and consider them to be the basis on which our Users adhere to the Adviise website and the services which it offers.

Insurance Data

Insurance data on Adviise is offered for informational purposes only, should not be relied upon, and users agree to hold harmless Adviise and its data suppliers for use of the data.

Changes to this Privacy Policy

We reserve the right to modify this privacy statement at any time, so please review it frequently. If we make material changes to this policy, we will notify you here, by email, or by means of a notice on our home page. We generally post updates to this policy once per year or as applicable. By continuing to use the Adviise service after notice of changes have been sent to you or published on the Adviise website, you are consenting to the changes.

If you use the Adviise service after notice of these changes have been posted, you are providing your consent to the changed practices.

In order to secure your personal information, access to your data on Adviise is password-protected. It is your responsibility to protect the security of your login information.

FOR CLIENT ACCOUNTS

1. INFORMATION WE COLLECT AND HOW WE USE IT

We may collect and store information about you in connection with your use of the Service, including any information you transmit to or through the Service. We use that information to provide the Service’s functionality, fulfill your requests, improve the Service’s quality, engage in research and analysis relating to the Service, personalize your experience, track usage of the Service, provide feedback to third party businesses that are listed on the Service, display relevant advertising, market the Service, provide customer support, message you, back up our systems, allow for disaster recovery, enhance the security of the Service, and comply with legal obligations. Even when we do not retain such information, it still must be transmitted to our servers initially and stored long enough to process.

Please also note:

Account Information: If you create an Adviise account, we may store and use the information you provide during that process, such as your full name, email address, zip code, physical address, and other information you may provide with your account, such as your gender, phone number, and birth date. We may publicly display your first name and last initial, as well as any photo or other content you submit through the registration process, as part of your account profile. You can modify some of the information associated with your account through your account settings. If you believe that someone has created an unauthorized account depicting you or your likeness, you can request its removal by contacting support at How@Adviise.com.

Public Content: Your contributions to the Service are intended for public consumption and are therefore viewable by the public, including your photos, ratings, reviews, tips, lists, collections, compliments, and edits to provider listing information.

Communications: When you sign up for an account or use certain features, you are opting to receive messages from other providers’ businesses and Adviise. You can manage some of your messaging preferences through your account settings, but note that you cannot opt out of receiving certain administrative, transactional, or legal messages from Adviise. For example, if you make an appointment, purchase procedures, or rate a provider, we may send you messages about your transaction using the contact information you provide, including through automated SMS text messages to your phone number. We may also track your actions in response to the messages you receive from us or through the Service, such as whether you deleted, opened, or forwarded such messages. If you exchange messages with others through the Service, we may store them in order to process and deliver them, allow you to manage them, and we may review and disclose them in connection with investigations related to use of the Service, as well as our efforts to improve the Service. We may not deliver messages that we believe are objectionable, such as spam messages, fraudulent solicitations, or requests to exchange reviews for compensation. If you send or receive messages through the Service via SMS text message, we may log phone numbers, phone carriers, and the date and time that the messages were processed. Carriers may charge recipients for texts that they receive. We may also store information that you provide through communications to us, including from letters, emails or other electronic messages. Any calls with you may be monitored and recorded for quality purposes.

Transactions: If you initiate a transaction through the Service, such as a reservation or purchase, we may collect and store information about you, such as your name, phone number, address, email, and payment information (such as a credit card number and expiration date), as well as any other information you provide to us, in order to process your transaction, send communications about them to you, and populate forms for future transactions. This information may be shared with third parties, and third parties may share such information with us, for the same purposes. When you submit credit card numbers, we encrypt that information using industry standard technology. If you write reviews about businesses with which you transact through the Service, we may publicly display the fact that you transacted with those businesses. For example, if you make a dinner reservation through the Service and write a review about your experience, we may publicly display the fact that you made your dinner reservation through the Service.

Activity: We may store information about your use of the Service, such as your search activity, the date and time of your appointments, purchases, and transactions you make through the Service. We may also store information that your computer or mobile device may provide to us in connection with your use of the Service, such as your browser type, type of computer or mobile device, browser language, IP address, WiFi information such as SSID, mobile carrier, phone number, unique device identifier, advertising identifier, location (including geolocation, beacon based location, and GPS location), and requested and referring URLs and mobile applications. We may also receive and store your location whenever our mobile applications are running, including when running in the background, if you enable our mobile apps to access such information in the course of using the Service. You may be able to limit or disallow our use of certain location data through your device or browser settings, for example by adjusting the "Location Services" settings for our applications in iOS privacy settings.

Different Devices: You may access the Service through different devices (e.g., your mobile phone or personal computer) and different platforms (e.g., www.Adviise.com or Adviise mobile apps). The information that we collect and store through those different uses may be cross-referenced and combined, and your contributions through one Adviise platform will typically be similarly visible and accessible through all other Adviise platforms.

Legal Basis for Processing: For residents of the EEA and Switzerland only, our legal basis for collecting and using the information described above will depend on the specific information concerned and the context in which we collect it. We, however, will normally collect personal information from you only where we have your consent to do so, where we need the personal information to perform a contract with you, or where the processing is in our legitimate interests and not overridden by your data protection interests or fundamental rights and freedoms. In some cases, we may also have a legal obligation to collect personal information from you or may otherwise need the personal information to protect your vital interests or those of another person (for instance, to prevent, investigate, or identify possible wrongdoing in connection with the Service or to comply with legal obligations). If we ask you to provide personal information to comply with a legal requirement or to perform a contract with you, we will make this clear at the relevant time and advise you whether the provision of your personal information is mandatory or not (as well as of the possible consequences if you do not provide your personal information). If we collect and use your personal information in reliance on our legitimate interests (or those of any third party), this interest will typically be to operate our Services, communicate with you in relation to our Services, or for our other legitimate commercial interests, for instance, when responding to your queries, to analyze and improve our platform, engage in marketing, or for the purposes of detecting or preventing fraud. Adviise, and third parties with whom we partner, may use cookies, web beacons, tags, scripts, local shared objects such as HTML5 and Flash (sometimes called "flash cookies"), advertising identifiers (including mobile identifiers such as Apple’s IDFA or Google’s Advertising ID) and similar technology ("Cookies") in connection with your use of the Service, third party websites, and mobile applications. Cookies may have unique identifiers, and reside, among other places, on your computer or mobile device, in emails we send to you, and on our web pages. Cookies may transmit information about you and your use of the Service, such as your browser type, search preferences, IP address, data relating to advertisements that have been displayed to you or that you have clicked on, and the date and time of your use. Cookies may be persistent or stored only during an individual session.

The purposes for which we use Cookies in the Service include:

  • To make the Service work in the way you expect. For example, we use a Cookie that tells us whether you have already signed up for an account.

  • To prevent fraud, protect your data from unauthorized parties, and comply with legal requirements. For example, we use Cookies to determine if you are logged in.

  • To remember information about how you prefer the Service to behave and look. For example, we use a Cookie that tells us whether you have declined to allow us to send push notifications to your phone.

  • To allow or prevent notices of information or options that we think could improve your use of the Service. For example, we use a Cookie that stops us from showing you the signup notification if you have already seen it.

  • To make advertising more relevant to users and more valuable to advertisers. For example, we may use Cookies to serve you interest-based ads, such as ads that are displayed to you based on your visits to other websites, or to tell us if you have recently clicked on an ad.

3. ANALYTICS

Intended to help us understand how visitors use the Service. For example, we use a Cookie that tells us how our search suggestions correlate to your interactions with the search page.

You can set some Cookie preferences through your device or browser settings, but doing so may affect the functionality of the Service. The method for disabling Cookies may vary by device and browser, but can usually be found in your device or browser preferences or security settings. Please note that changing any of these settings does not prevent the display of certain advertisements to you.

4. THIRD PARTIES

Third parties may receive information about you as follows:

We may allow third parties to use Cookies through the Service to collect the same type of information for the same purposes as we do. In doing so, we adhere to the Digital Advertising Alliance’s Self-Regulatory Principles for Online Behavioral Advertising. Third parties may be able to associate the information they collect with other information they have about you from other sources. We do not necessarily have access to or control over the Cookies they use, but you may be able to opt out of some of their practices by visiting the following links: Network Advertising Initiative, Omniture and Digital Advertising Alliance. Please note that opting out does not prevent the display of all advertisements to you. Additionally, we may share non-personally identifiable information from or about you, such as location data, advertising identifiers, or a cryptographic hash of a common account identifier (such as an email address), with third parties in connection with advertising programs and data analytics, including with third parties that help determine the efficacy of such advertising programs by aggregating information they receive from multiple services like the Service. You may be able to limit our sharing of some of this information through your mobile device settings, as described in Section 2 above, or through the Service’s settings.

Content Partners: We allow third party partners to use and display some of the public content available through the Service, such as your photos, reviews, and other information detailed in Section 1(b) above.

Service Providers: We may rely on third party providers to support or provide some of the services that are available through the Service, such as reservations and food delivery. We may also rely on third party providers to perform certain services for us in connection with your use of the Service, such as communications and hosting services, network security, technical and customer support, tracking and reporting functions, quality assurance testing, payment processing, our own marketing of the Service, and other functions. We may share information from or about you with these third party providers so that they can perform their services or complete your requests. These third party providers may share information with us that they obtain from or about you in connection with providing their services or completing your requests. Third party providers may also share this information with their subsidiaries, joint ventures, or other companies under common control. Some of our web pages utilize framing techniques to serve content to you from our third party providers, while preserving the look and feel of the Service. In such cases, please note that the information you provide is being provided to the third party.

Aggregate or Anonymous Information: We may share user information in the aggregate with third parties, such as businesses that are listed on Adviise and content distributors. For example, we may disclose the number of users that have been exposed to or clicked on advertisements. We may also disclose anonymized information about your use on Adviise. For example, if you engage in a transaction in connection with Adviise, we may publicly disclose information about the transaction without providing additional identifying information about you or otherwise disclosing your participation in the transaction.

Business Transfers: We may share information from or about you with our parent companies, subsidiaries, joint ventures, or other companies under common control, in which case we will require them to honor this Privacy Policy. If another company acquires Adviise, or all or substantially all of our assets, that company will possess the same information, and will assume the rights and obligations with respect to that information as described in this Privacy Policy.

Businesses on Adviise: We may share information from or about you (such as your age, gender, and city), your devices, and your use of the Service (such as which businesses you bookmark or call, or if you visit a business’s URL) with businesses listed on Adviise. You may adjust your account settings to increase or decrease the amount of information we share. Keep in mind that businesses may still see your public activity and posts, and may receive information from or about you when you transact or communicate with them, through Adviise or otherwise, regardless of your settings (see Section 1 above). Additionally, if you make a phone call to a business through or in connection with your use of the Service, we may share information about your call with the business that the business would have received had you called them directly, such as the date and time of your call and your phone number. You may be able to limit our ability to collect and share your phone number through your phone’s settings or phone service provider.

Investigations and Legal Disclosures: We may investigate and disclose information from or about you if we have a good faith belief that such investigation or disclosure: (a) is reasonably necessary to comply with legal processes and law enforcement instructions and orders, such as a search warrant, subpoena, statute, judicial proceeding, or other legal process or law enforcement requests served on us; (b) is helpful to prevent, investigate, or identify possible wrongdoing in connection with the Service; or (c) protects our rights, reputation, property, or that of our users, affiliates, or the public, such as disclosures in connection with Adviise’s Consumer Alerts program. If you flag or otherwise complain to us about content through the Service, we may share the substance of your complaint with the contributor of that content in order to provide an opportunity for the contributor to respond.

Links: The Service may link to third party services, like a business’s URL. Except as set forth herein, we do not share your personal information with them, and are not responsible for their privacy practices. We suggest you read the privacy policies on or applicable to all such third party services.

Third Party Accounts: If you sign up for, or log into, Adviise using a third party service like Facebook or Google, or link your Adviise account to your account with a third party service like Facebook, Instagram or Twitter, we may receive information about you from such third party service. If you post content to a third party service through the Service, that third party service will also receive that content, which will be visible to anyone that has access to it through that third party service.

5. CONTROLLING YOUR PERSONAL DATA

Other users may be able to identify you, or associate you with your account, if you include personal information in the content you post publicly. You can reduce the risk of being personally identified by using the Service pseudonymously, though doing so could detract from the credibility of your contributions to the Service. Adviise users can also use the Find Friends feature to find one another based on their names or email addresses. You can adjust the settings for this feature in your account settings. Please also note that the messages you send or receive using the Service are only private to the extent that both you and the person you are communicating with keep them private. For example, if you send a message to another user, that user may choose to publicly post it. Also, we may access, review, and disclose such messages in connection with investigations related to use of the Service, as well as our efforts to improve the Service.

If you are a resident of the EEA or Switzerland, you have the right to access, correct, update or request deletion of your personal information. You can object to the processing of your personal information, ask us to restrict processing of your personal information or request portability of your personal information. Similarly, if we have collected and processed your personal information with your consent, then you can withdraw your consent at any time.
